Fairness in Contractual Relationships

One of the most fundamental concepts of fairness in the Quran is the need for impartiality and equity in contractual relationships. The Quran emphasizes the importance of fulfilling one’s obligations fairly and equally, regardless of one’s social status or position of authority.

This principle is conveyed through verses such as: “And fulfill the covenant of Allah ( witnessed by mankind ) and break not the oaths (once made) ” (17:34) and “Then fulfill your promise, and indeed, Allah will ask you about your promises, and He will let you know (the consequences of fulfilling or violating them)” (14:94). These verses underscore the importance of keeping promises and fulfilling contracts fairly and equally, regardless of the nature or value of the contract.

Equity in Legal Matters

In Islamic legal theory, the concept of equity plays a crucial role in balancing the letter of the law with the requirements of social justice and fairness. One of the most significant expressions of equity in Islamic law is ‘istishaan fi’l qurun’ (equitable adaptation), which involves applying legal principles in a manner that is just and fair, given the specific circumstances of the case.
